Music MCN hosts recordings that creators upload. If you believe something here infringes your copyright, this page is how to tell us, and what we do about it.
Reporting a copyright infringement
Send a notice using the form below, or by post or email to our designated agent. US law requires a notice to contain all of the following. A notice missing any of them is still recorded and answered, but we cannot act on it until it is complete.
- A signature — physical or electronic — of a person authorised to act for the owner
- Identification of the copyrighted work said to be infringed
- Identification of the material said to infringe, with enough detail for us to find it
- Your address, telephone number and email address
- A statement that you believe in good faith the use is not authorised by the owner, its agent, or the law
- A statement that the information is accurate, and — under penalty of perjury — that you are authorised to act for the owner
Knowingly misrepresenting that material is infringing carries liability for damages and costs under 17 U.S.C. §512(f). Please be sure before you send.
Designated agent
Our designated agent registration with the US Copyright Office is not yet complete. We are telling you that rather than listing an agent we have not filed.
In the meantime, send notices through the form below or to copyright@musicmcn.com. They are recorded and answered exactly the same way.
What happens after you send a notice
- We acknowledge it and record it, with the date.
- If anything required is missing we tell you what, so you can complete it.
- If it is complete, we review it and — where it is upheld — remove or disable access to the material expeditiously.
- We tell the creator what was removed, who complained, and how to send a counter-notice.
Counter-notices
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice. We pass it to the complainant. If they do not tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
A counter-notice requires consenting to the jurisdiction of a US federal court and is made under penalty of perjury. It is not a form to fill in casually, and we cannot advise you on whether to send one — we are not anyone’s lawyer.
Repeat infringer policy
We close the accounts of repeat infringers. Specifically:
- A notice that we review and uphold is a strike against the account that uploaded the material.
- An accusation on its own is not a strike. If it were, anyone could close a creator’s account by filing complaints.
- A successful counter-notice removes the strike.
- Strikes expire 365 days after they are recorded.
- At 3 strikes the account is closed and no further releases are delivered. Earnings already accrued are not affected and are paid out normally.
- We also close accounts immediately, without waiting for strikes, in clear cases — uploading a commercially released recording somebody plainly has no rights to.
